General Terms & Conditions

Article 1 — Definitions
In these General Terms and Conditions, the following definitions apply:

1. Cooling-off period:
the period within which the consumer may exercise the right of withdrawal.

2. Consumer:
a natural person acting for purposes outside their trade, business or profession who enters into an agreement with the entrepreneur.

3. Day:
calendar day.

4. Durable medium: any tool enabling the consumer or entrepreneur to store information personally addressed to them in a way accessible for future reference and unchanged reproduction.

5. Right of withdrawal: the consumer’s right to cancel the distance contract within the cooling-off period.

6. Entrepreneur: the natural or legal person offering products to consumers at a distance.

7. Distance contract: an agreement concluded exclusively via distance communication within a system organised by the entrepreneur.

8. General Terms & Conditions: the present General Terms & Conditions of Oil & Ohm.

Article 3 — Applicability

1. These General Terms & Conditions apply to all offers, orders and distance contracts between Oil & Ohm and the consumer.

2. Before concluding the agreement, these terms are made available electronically in a way that allows storage on a durable medium.

3. If specific product conditions apply in addition to these General Terms & Conditions, the most favourable provision for the consumer shall prevail.

4. If any provision is invalid or unenforceable, the remaining provisions remain in force.

Article 4 — The Offer

1. All offers are without obligation and may be changed at any time.

2. Product descriptions and images are presented as accurately as possible. Slight variations may occur and do not constitute grounds for compensation.

3. Obvious errors or mistakes do not bind the entrepreneur.

Article 5 — The Agreement

1. The agreement is concluded upon acceptance of the offer and completion of the order.

2. The entrepreneur confirms receipt of the order electronically.

3. Oil & Ohm reserves the right to refuse orders if legal or practical reasons apply.

Article 6 — Right of Withdrawal

The consumer has the right to withdraw from the agreement within 14 days after receipt of the product, without stating reasons, provided that the product is unopened, unused and undamaged.
During the withdrawal period, the consumer shall handle the product and its packaging with care. The product may only be unpacked or inspected to the extent necessary to establish its nature and characteristics, without breaking the seal.
For hygienic and safety reasons, cosmetic products cannot be returned once the seal has been broken or the product has been opened, unless the product is defective or does not comply with the agreement.
In the event of a defect or non-conformity, the consumer must notify Oil & Ohm within a reasonable time after discovery. Oil & Ohm will assess the complaint and, where appropriate, offer a replacement or refund in accordance with applicable law.
To exercise the right of withdrawal, the consumer must notify Oil & Ohm within 14 days after receipt of the product and return the product within 14 days thereafter, unopened and in its original condition.

Article 7 — Costs in Case of Withdrawal

1. Return shipping costs are borne by the consumer.

2. Refunds are made within 14 days after receipt of the returned goods or proof of return.

Article 8 — Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for sealed cosmetic products which are not suitable for return for reasons of health protection or hygiene, once the seal has been broken after delivery.

2. This exclusion applies only when this condition has been clearly communicated to the consumer before purchase, for example on the product page or in the returns policy.

Article 9 — Prices

1. All prices include VAT unless stated otherwise.

2. Prices may change, but orders are charged at the price applicable at the time of purchase.

3. Typographical errors do not bind the entrepreneur.

Article 10 — Conformity & Warranty

1. Products comply with applicable Dutch and EU regulations for cosmetic products.

2. Oil & Ohm is not responsible for individual allergic reactions. Consumers are advised to review ingredient lists and perform a patch test before use.

3. Complaints regarding defects must be reported within a reasonable time after discovery.

Article 11 — Delivery

1. Orders are shipped with care and usually within 2–3 business days.

2. Delivery times are indicative.

3. Risk transfers to the consumer upon delivery.

Article 12 — Duration Transactions

Not applicable, as Oil & Ohm does not offer subscriptions or recurring delivery agreements.

Article 13 — Payment

1. Payments must be completed immediately upon placing the order, unless agreed otherwise.

2. In case of non-payment, Oil & Ohm may suspend or cancel the order.
